2 men sentenced to die by a corrupt judge should receive a new sentencing hearing, but their convictions will stand, according to a ruling issued by the U.S. Court of Appeals in Chicago. William Bracy and Roger Collins were convicted in a 1980 triple murder and sentenced to death by Cook County Circuit Judge Thomas J. Maloney, who subsequently was imprisoned for taking bribes from defendants. The 2 appealed, saying they received an unfair trial from a judge biased against defendants who didn't offer him bribes. Explaining the decision, Appeals Judge Terence Evans wrote that it was fair to infer Maloney sentenced the men to die in order to "deflect suspicion" that he was too soft on defendants because he was taking bribes.
