A barber from Hong Kong whose death sentence for dadah trafficking was upheld by the Federal Court of Malaysia, last year is seeking a review of his conviction because the chemist who analysed the dadah sample had failed to state its actual weight.
The motion by Chu Tak Fai, supported by the affidavit of his lawyer Karpal Singh, was filed at the Federal Court registry. Chu, 31, was sentenced to death by the Alor Star High Court on Oct 11, 1994, for trafficking in 2.12kg of heroin at the Immigration Complex in Bukit Kayu Hitam on April 30, 1993. The Court of Appeal dismissed his appeal on April 16, 1997, and it was upheld by the Federal Court on Aug 20 last year.
Chu has made a representation for clemency to the Kedah Pardons Board and is awaiting the decision. In his affidavit, Karpal said the Federal Court had the inherent power under Rule 137 of the Rules of the Federal Court 1995 to review the case "to prevent injustice."
This was in the light of two Court of Appeal rulings in 2000 and on June 11 this year on the actual weight of the dadah taken for analysis.
