A division bench of the Allahabad High Court urged the Indian Parliament to amend the law and provide for the death penalty for gang-rape.
Justices M Katju and S K Singh, dismissing a petition by [a convict] Kareshpal, said that in cases of gang rape of a girl, the victim's mind may be permanently damaged by the psychological trauma and it may be worse than killing the victim.
Kareshpal had advanced a habeas corpus petition on the grounds that he had not been provided with copies of documents used to convict and jail him.
