A federal appeals court threw out the death sentence of an Oklahoma man convicted of killing his 7-year-old former stepdaughter in 1984. The 10th U.S. Circuit Court of Appeals ruled 3-0 that the trial judge violated Richard Norman Rojem's constitutional rights. The judge gave jurors improper instructions about determining Rojem's sentence, the appeals court concluded. Another penalty phase trial will be held, and a new jury will decide whether to sentence Rojem to death or to life in prison.
