A group of lawyers has cautioned President Arroyo against allowing the execution of convicted kidnappers Roderick Licayan and Roberto Lara. The Free Legal Assistance Group (FLAG) said it would be premature and against the law to execute them in August, as announced.
Theodore Te, FLAG's acting campaign coordinator, said Republic Act no. 8177, the law prescribing lethal injection as the mode of execution in the country, states that "the death sentence shall be carried out not earlier than one year, nor later than 18 months after the judgement has become final and executory."
Licayan and Lara, whose death sentences have been affirmed by the Supreme Court, became final and executory only on Nov. 9, 2001, Te said in a statement.
"Consequently, the law prohibits an execution earlier than Nov 9, 2002 any execution carried out earlier than this date would be, quite simply, illegal."
