A unanimous 3-judge panel of the 9th U.S. Circuit Court of Appeals set aside the special circumstance conviction of rape that made David Ghent eligible for the death penalty.The Court commuted the death sentence of Ghent to a life term. Ghent was convicted of murdering and attempting to rape Patricia Bert, 25, in 1987. The court concluded that Ghent's 1979 trial was tainted by the admission of evidence from an interview he gave to a police psychiatrist after his arrest, when he wasn't properly apprised of his Miranda rights.
