A woman convicted of murdering her two-year-old son was spared the death sentence because of doubts about her age, and having a one-year-old child, conceived whilst in custody.
Lady Justice Sarah Ondeyo, who convicted Chelangat Sigilai of murder, had been expected to pass an automatic death sentence. However instead of ordering her to be hanged, the judge ordered that Siligai should be placed in prison custody "at the pleasure of the President". It means the President can order her release should he so wish.
Sigilai was found guilty of strangling Collins Kiptoo, and throwing his body in the river at Kiptaragon village, Nakuru, on October 12, 1999. The judge said that she was taking into account the fact that Sigilai may have been under 18 when she committed the crime, and minors under 18 cannot be condemned to death. Justice Ondeyo ordered an investigation into Sigilai's claim that she was raped by another suspect at Molo police station, leading to the birth of her child.
