A woman in east China's Zhejiang Province gave herself and the justice department an unprecedented challenge: she wants to have a baby through artificial insemination, for her husband who is sentenced to death for murder but yet to be executed.
Zheng Xueli, from Zhoushan city, told reporters that she decided to help her husband leave a child behind after seeing the grief of her parents-in-law when their son was sentenced to death in July.
Zheng's application was turned down by the local court, upon which she filed an application to the Higher People's Court of Zhejiang Province, together with an appeal against her husband's death.
Her husband, Luo Feng, was sentenced to death by the intermediate people's court of Zhoushan city for murdering the deputy manager of the company he worked for, in May, when the latter refused to reimburse him five yuan.
The higher people's court has yet to make any decision, although officials have told reporters that Zheng may need to submit other documents, so that the application might be seriously considered.
Lawyers said Zheng's application, the first ever in China, could be granted, as the law only deprives a prisoner of his freedom or political rights, but he may have other rights.
