About 2 hours before he was scheduled to be executed, Brian Davis was spared from lethal injection with a reprieve from the U.S. Supreme Court.
Davis, 33, fatally stabbed Michael Alan Foster in 1991.
Attorneys for Davis, however, argued in an 11th-hour appeal that he was mentally retarded.
The high court is considering a Virginia case (Atkins vs. Virginia ) that challenges the constitutionality of executing the mentally retarded and a ruling is expected before July.
