Afghanistan's chief justice says the divine law has to be applied if proof of a crime is furnished.
Afghanistan's chief justice, Fazl Hadi Shinwari, told Afghan Islamic Press that: "Afghanistan is an Islamic country which has been recognized as such all over the world and by the United Nations."The leader [chairman] of the existing government [administration], esteemed Hamed Karzai, has entrusted me with the competence that every decision inside Afghanistan has to be in conformity with the Shari'ah [divine law]."
He added: "On this basis in all three courts [primary, litigation and appeal] in Afghanistan the divine law has to be applied if the proof of a crime is completely produced."
He said: "If the proof of culpability is furnished, the hand of a thief will be amputated, the adulterer lashed or stoned, the murderer executed and wine drinkers and some others punished in line with Islamic principles. But the primary condition is that the offence has been completely proven and there is no room for any doubt or hesitation".
