Capital crimes are: murder, robbery, sorcery, offenses against the State and crimes against humanity. Many of those implicated in the 1994 genocide are preparing to stand trial before the international tribunal set up by the UN in Tanzania, which will not impose any death penalties.
In 2001, was introduced the Gacaca justice system that is expected to become operational early in 2002. Gacaca is a version of a traditional justice system that the government of Rwanda has introduced to expedite thousands of genocide trials. The Gacaca courts will try those accused from category II of the genocide suspects and the most severe verdict they can give is life imprisonment.
Of the 120,000 suspects charged with crimes related to the 1994 genocide, only 2,500 cases were completed by the national courts between 1997, when courts began functioning again, and April 2001. About 400 people were sentenced to death, 22 of whom were executed in 1998. Others received various sentences ranging from life to a few years imprisonment. About 700 were acquitted. Since 1996, Rwandan law has divided suspects of genocide and crimes against humanity into four categories according to the seriousness of the crime.
