Capital punishment was abolished from the Criminal Code on December 10, 1999, when the Constitutional Court considered the death penalty to be against the spirit of the new Constitution approved by a popular referendum on November 22, 1998.
The Constitution sanctions the principle that "in Albania man's life is protected by law".
Under the Military code, that still envisages the death penalty, people who were below the age of 18 at the time when the crime was committed and women cannot be condemned to death.
