Chan Chor Shun, 45, a businessman, was convicted and sentenced to death by the Kuantan High Court on June 4, 1996, but today the Court of Appeal set aside the conviction and sentence against him.
Court of Appeal three-member panel, led by Datuk Mokhtar Sidin, unanimously agreed there was reasonable doubt in the prosecution's case as to who arrested Chan and where the packet of drugs was found.
The other judges in the panel were Datuk Abdul Kadir Sulaiman and Datuk P.S. Gill. Mokhtar said it was the prosecution's burden to prove the case beyond reasonable doubt.
