David Hicks, a 26-year-old Autralian captured fighting with al-Qaeda forces in Afghanistan in December 2001, has been transferred to a US marine base at Cuba's Guantanamo Bay.
Critics have questioned the legality of the move to Cuba after the US classified Hicks and others as battlefield detainees beyond the scope of the 1949 Geneva Convention covering prisoners of war.
Mr Hicks [David's father] called on the Australian government to push for his son's return to his native country.
Asked if he was concerned his son could face the death penalty if tried in the US, Mr Hicks replied: "I don't think he'll face the death penalty because ... there's no law to cover that situation at this stage, unless they make one up themselves."
