David Hicks, the Australian prisoner in Cuba, was given a new ray of hope of being tried in Australia when the US said it would agree to repatriate British prisoners from Guantanamo Bay.
US Defence Secretary Donald Rumsfeld told a British newspaper he would agree to allow five British prisoners alleged to have been Taliban or al-Qaeda fighters, to be tried in British courts.
In an interview to be published in Britain's Daily Telegraph, Rumsfeld is quoted as saying he would repatriate the five so long as the British government pledged to prosecute them and make them available for further interrogation by US officials.
This would automatically remove the Britons from any threat of a death penalty under US law for their alleged activities. If the same deal were extended to Hicks, he too would be put under Australian law and out of the reach of capital punishment.
