Donny Crook, condemned to death for the 1996 murder of 59-year-old Betty Spurlock 6 years ago, must have a new sentencing hearing, the state Supreme Court said. In an unsigned 4-3 decision, Florida's high court said the trial judge erred in not considering "uncontroverted" evidence from 3 medical experts that Donny Crook had brain damage. The majority also said the judge failed to take into account the testimony that Crook was borderline mentally retarded.
