Gary Black was sentenced to death for the 2nd time. Black, 50, was convicted of 1st-degree murder in the Oct. 2, 1998 stabbing death of Jason O. Johnson, 28. Black is white, Johnson was black.
A previous conviction and death sentence by another Jasper County Circuit Court jury in 1999 were reversed on November 23, 2004 (see) by the Missouri Supreme Court, which ordered a new trial. The Court overturned the 1st conviction on the grounds that Black’s lawyers failed to adequately question conflicting testimony on whether the slaying was premeditated.
Circuit Judge Jon Dermott set formal sentencing for June 9.
