Germany refused to pass on evidence to the US that could lead to the death penalty being invoked against the so-called 20th hijacker. German Justice Minister, Herta Daeubler-Gmelin told Der Spiegel magazine, that Germany would only cooperate in the case against 11 September suspect Zacarias Moussaoui, if America guaranteed the documents would not be used for obtaining the death penalty.
