In Denver, the 10th U.S. Circuit Court of Appeals overturned the death sentence of Roderick L. Smith, convicted of murdering his wife and four stepchildren. The Court concluded 3-0 that at least 1 juror might have blocked the death sentence if Smith's trial attorney had adequately defended him. They upheld Smith's conviction and ordered that his sentence be reconsidered in Oklahoma County District Court where he could receive a lesser sentence. Smith was convicted of the 1993 murders of Jennifer Smith and her children ranging in age from 6 to 10.
