In Prescott, a jury decided that Homer Roseberry, 59, deserves the death penalty for the 2000 shooting death of Fred Fottler, 45. Roseberry is the 1st Yavapai County defendant to receive capital punishment by the determination of a jury rather than a judge, which is a new statutory provision that the Arizona Legislature enacted recently as a result of a U.S. Supreme Court decision. In December, the same jury convicted Roseberry of 1st-degree murder and determined that there was an aggravating factor in his crime - meaning that he committed the murder for monetary gain. Roseberry reportedly conspired to steal from Fottler more than 1,000 pounds of marijuana. Yavapai County Superior Court Judge William Kiger set sentencing at 3:30 p.m. on June 30.
