the Nagpur bench of the Bombay high court in India referred back a petition of death sentence to the lower court citing that the "convict failed to get enough chances to prove his credentials." Shatrughan Nimbalkar was accused of kidnapping and killing a two-year-old boy in Khamgaon on August 28, 2004. A division bench comprising justices A P Lavande and P B Varale directed the Khamgaon sessions court to decide the case before August 30.
