Indiana forbids the execution of the mentally retarded but does not forbid the execution of juvenile offenders

Indiana forbids the execution of the mentally retarded but does not forbid the execution of juvenile offenders. The state has life without parole. Sentencing is decided by a judge, who can override the jury's recommendation. The Governor on the advice of the Parole Board has the power to grant clemency. The Governor needs a favorable recommendation of the Board to be able to grant clemency. The Governor, however, is not bound by the favorable recommendation.
