it was unlikely that Saddam would be tried within the next few months seeing as “the need to select judges for the trial and a place in which to hold it, has caused a delay in the setting up of the Special Iraqi Tribunal for crimes against humanity,” according to Dara Noor al-Din, the judge in charge of paving the way for the former dictator’s trial.
Amongst the reasons for the delay were also the accusations made by Human Rights Watch, according to which the norms laid out by the Governing Council were not adequate enough to assure a fair and credible trial.
The norms did not allow for the handing over of the trial to non Iraqi judges, and al-Din had already underlined the fact that magistrates in the country had no experience when it came to judging grave human rights abuses.
The Coalition Provisional Authority had temporarily suspended the application of the death penalty in the country, but if capital punishment should be applied once more following the transfer of power on June 30, Saddam Hussein could be sentenced to death if found guilty.
