James "Jeff" Cahill, 43, was sentenced to 37 1/2 years in prison for sneaking into his wife's hospital room and poisoning her with cyanide. In a split decision, the Court of Appeals said on November 25 (see) that there was insufficient evidence to support first-degree murder charges against Cahill. He was convicted of first-degree murder and sentenced to death in 1999. But state law requires an aggravating factor to be present for 1st-degree murder charges, and the court said the factors cited in the Cahill case weren't enough.
