New York forbids the execution of the mentally retarded and prohibits the execution of juveniles by requiring that the offender be "more than 18" at the time of the crime. The state has life without parole. A jury decides the sentence. The Governor has the sole authority to commute a death sentence to a term of life without parole. A week after the terroristic attack of September 11, the New York Legislature adopted an Anti-Terrorism Act that establishes six new terrorism-related offences, and amends the state's death penalty statute to allow the death penalty for someone who commits murder in furtherance of terrorist activity.
