Jose Briseno's lethal injection was halted by the Texas Court of Criminal Appeals less than 4 hours before he was scheduled to be executed after his attorneys found a prison record indicating the former laborer had an IQ that would make him mentally retarded.
The U.S. Supreme Court last month ruled it is unconstitutional for mentally retarded people to be executed.
Briseno, 45, was convicted of capital murder for the slaying of Ben "Doc" Murray, who had been the Dimmit County sheriff for almost 20 years when he was killed Jan. 5, 1991.
