Public Prosecutions director Keriako Tobiko said the consultations would require at least one month. The Appellate Court directed Public Prosecutions director and Attorney-General Amos Wako to personally respond to Godfrey Ngotho Mutiso's challenge, that the death penalty was unconstitutional. Mutiso was sentenced to death in 2008 by a Mombasa judge after he was found guilty of murdering Mr Patrick Waweru Gachoki in Mkomani in 2004.
