Marion County Circuit Judge Don Dickey, who ruled in April 2001 that Randall Loyal Smith, 48, did not receive a fair sentencing hearing, accepted an amended sentence giving Smith life in prison without the possibility of parole.
Smith was convicted in 1992 in Washington County of murdering Kathy Demarest on Sept. 20, 1990.
Dickey did not overturn the conviction but ruled that the sentencing was unfair because Smiths lawyer had not adequately represented him.
