Marivic Genosa, a woman jailed and convicted for the murder of her husband, had her death sentence commuted to six years imprisonment by the Philippine's Supreme Court due to "mitigating circumstances". The Regional Trial Court of Ormoc City had originally sentenced Ms. Genosa to death in 1998 after ruling that she had killed her husband in 1995. "Under the proven facts, she is not entitled to complete exoneration because there was no unlawful aggression - no immediate and unexpected attack on her by her batterer-husband at the time of the murder," the Supreme Court said. "If there is no unlawful aggression, there can be no self-defence," the court added. But the Court stressed the severe beatings repeatedly inflicted on Ms. Genosa were in themselves a form of cumulative provocation that broke down her psychological resistance and self-control.
