Montana forbids the execution of the mentally retarded and juvenile offenders. The state has life without parole. The Governor has the power to grant clemency with the advice of the Board of Pardons. The Governor must have a favorable recommendation to grant clemency. However, the Governor is not bound by that recommendation.
