No Mexican court has applied the death penalty since the 1950s. The last execution took place in 1937.
The death-eligible offences included in Art. 22 were considered a threat to society when the Constitution was first introduced, and now have a symbolic function. The Armed forces are alone in opposing its full abolition as a matter of principle.
In 2001, the Supreme Court ruled that Mexican citizens can be extradited for trial abroad, provided they are sentenced under Mexican guidelines, which ban the use of the death penalty.
