Ntonyiri MP Maoka Maore asked the police to round up the 101 death row convicts released following a landmark court ruling. Maore asked Justice and Constitutional Affairs Minister Kiraitu Murungi to come out and state whether he had repealed the death penalty without going through Parliament.
"There is no legal technicality in setting free the convicts but a conspiracy between Kiraitu and the Judiciary," said Maore
He added, "We want those death row convicts rounded up and taken through a retrial."
"The government seems to have more respect for murderers than the families who lost their loved ones," said Maore. But the shadow minister for Justice and Constitutional, Affairs, Mr Mutula Kilonzo, held a different opinion. He said the freed convicts could not be retried. "You can never be re-tried by another court if the court that made the first ruling was a competent court. The situation is what we call in law double jeopardy," he said.
