John King'ori Wachira and John Maina Mwangi were sentenced to death by hanging after being found guilty of storming into their victim's home armed with a toy pistol and other crude weapons and robbing him of money and a mobile phone on 20 February 2003.
Following a tip-off, police raided a house in which the two suspects were sleeping and recovered the cell-phone. Wachira told the court in mitigation that he suffered from a stroke and could therefore not defend himself, while Mwangi pleaded that he was an orphan, but the magistrate said the law did not offer an alternative sentence for violent robbers.
