On December 11, 5 suspects - Joseph Nyamu Kamotho, Bernard Mwngi Maina, Stephen Mwangi Gathua, Emmanuel Kamunya, Paul Kariuki Ngothi - who had been charged with robbery with violence and sentenced to death by the Nyahururu Principal Magistrate W. Karanja on April 15, 1997, were set free by the High Court in Nairobi. Judges S.O. Oguk and J.K. Mitey said that they "had come to the conclusion that the prosecution case was not proved beyond reasonable doubt. The learned trial magistrate should have resolved the glaring gaps and contradictions in favor of the appellants."
