Peru has been abolitionist for common crimes since 1979, when the last execution was held. The death penalty is applicable under the Military Code for the act of treason committed during wartime with foreign power. In 1993, Congress approved a new Constitution introducing a new capital offense: terrorism (Art. 103). In doing this Peru violated the American Convention on Human Rights to which it is party, which under Art 4.2 prohibits the reintroduction of the death penalty.
