Randall Wayne Mays, 48, has been given the death penalty by an Athens jury today. Mays was convicted of killing sheriff's Deputy Tony Price Ogburn last May. Another deputy, Paul Steven Habelt, was killed in the shootout, and a 3rd was injured. The deputies were responding to a domestic disturbance call at Mays' house. Judge Carter Tarrance sentenced Mays to death by lethal injection, to be carried out at a later date. Mays’ brother, Noble Mays Jr., was executed in 1995. They are not the first set of brothers to wind up on death row in Texas. Jose Gutierrez was put to death in 1999, 5 years after his brother, Jessie, received lethal injection. Both were convicted of killing a jewelry store clerk in a 1989 robbery. Earlier, Curtis and Danny Harris were executed in July 1993. In the days when the electric chair was the method of capital punishment in the state, at least four sets of brothers were put to death, the first in 1925, the last in 1938.
