Roy Lee McDuffie, 44, who has spent more than 2 years on death row, was granted a new trial by the Florida Supreme Court.
McDuffie, was convicted of killing 2 store clerks, Janice Schneider, 39, and Dawniell Beauregard, 27, on Oct. 25, 2002, and sentenced to death after a lengthy trial on February 24, 2005 (see).
The Florida Supreme Court ruled that the trial court made errors -- not allowing a friend to testify, restricting the defense's cross-examination of 2 eyewitnesses and allowing the jury to hear a threatening voicemail left by the defendant -- that could have affected the outcome of the case.
