the Florida Supreme Court rejected another request to postpone the execution of Mark Dean Schwab, who is set to die on Nov. 15. In 1992, Schwab was sentenced to die for the kidnap, rape and murder of 11-year-old Junny Rios-Martinez.
Justice Barbara J. Pariente wrote in an opinion that it should be up to the U.S. Supreme Court to issue Schwab a stay if it intends to impose "a de facto moratorium on the death penalty."
2 justices -- Harry Lee Anstead and Peggy Quince -- dissented from the majority opinion.
