Sweden will have to negotiate with the USA on an exemption from the death penalty in the event of a suspected terrorist being extradited to the USA, Foreign Minister Anna Lindh said.
"Our legislation and the European convention are both opposed to the death penalty. In order to be able to fall in line with the UN resolution we will have to negotiate with the USA so that the death penalty can be avoided. In the case of other extraditions the USA has undertaken not to impose death sentences," Lindh said.
The issue came to the fore after the terrorist strikes against the USA. Several of those who are believed to have carried out the strikes have spent time in Europe in the past and their accomplices could still be in Sweden.
As a result of a UN resolution, Sweden has undertaken to assist in the hunt for the terrorists as far as possible. However, Swedish legislation regarding the extradition of persons threatened with the death penalty could cause problems.
"We will have to decide how to act the day that these two principles clash head-on. What is likely is that there would be such negotiations regardless of which EU country is involved."
Lindh was unable to say exactly what form negotiations would take.
