Ten death row prisoners in Kenya walked to freedom after the Court of Appeal set aside their convictions - because their prosecution was led by a police constable. State counsels conceded that the appellants were illegally condemned to death by the trial magistrates, who relied on unqualified prosecutors. Those released were Angas Katembo, Alfred Mumo Kioko, Danson Mjomba Mwanyumba, Deus Adam Khamis Ramadhan Simba, Tom Aden Onyango, Ali Mwinyi Suleiman, Charles Ouma Ogada, Benjamin Andai and Wyclife Owire Ogwara. They had been sentenced to death by different magistrates in Coast Province after being convicted of attacking Mr Anthony Mahiu on April 29, 1999, while armed with machetes.
