The Arizona Supreme Court on overturned the death sentence of a man who murdered his 13-year-old stepdaughter during a domestic dispute with his wife

The Arizona Supreme Court on overturned the death sentence of a man who murdered his 13-year-old stepdaughter during a domestic dispute with his wife. The Supreme Court said Wayne Benoit Prince must be sentenced again for the 1998 murder of Cassandra Parker, the daughter of Prince's wife, Christine Parker. The Supreme Court said it could not find beyond a reasonable doubt that a jury would have decided sentencing issues the same way as a judge who sentenced Prince. Those issues include factors that either support a death sentence or life in prison. The ruling was the latest in a series in which the state Supreme Court is considering whether to affirm or overturn death sentences because of a June 2002 ruling by the U.S. Supreme Court.
