The California Supreme Court reversed the death sentence of Randall Cash, condemned for the 1985 murder of Bud Smith.
The unanimous court set aside the death sentence but upheld the 1992 conviction - meaning he will serve a life sentence without parole unless prosecutors seek another trial.
The justices ruled that Cash's defense attorney, Mark Greenberg, was wrongly denied the right to quiz jurors about their feelings on the death penalty during the jury selection process.
The case is People v. Cash, S029460.
