The Carbon County Attorney's Office says it will not seek the death penalty

The Carbon County Attorney's Office says it will not seek the death penalty against James Harlow, whose death sentence and murder conviction were overturned on Feb. 16 (see) by a federal judge. County Attorney Cindy Lynn DeLancey says she cannot comment on the factors that led her to decide against seeking the death penalty again against inmate James Harlow, who was convicted of killing a prison guard at the state penitentiary in Rawlins. DeLancey says Harlow will be arraigned April 15 on a charge of premeditated felony murder in connection with the 1997 stabbing death of Cpl. Wayne Martinez.
