The Cincinnati-based U.S. District Sixth Circuit Court threw out the death penalty against Tony Powell, convicted in Hamilton County in 1986 of trying to rape Trina Dukes, a 7-year-old girl and then killing her on July 29, 1986. The court voided Powell's sentence, saying he had the right to have a psychologist of his choice to assist him rather than a state-appointed psychologist. The court ruled that Powell's death sentence is reversed "unless the State of Ohio conducts a new penalty proceeding within 180 days of remand."
