The Constitution of Senegal does not make a specific mention of the death penalty

The Constitution of Senegal does not make a specific mention of the death penalty. On the other hand it protects the right to life: "La personne humaine est sacrée. Elle est inviolable. L'Etat a l'obligation de la respecter et de la protéger. »
However the Penal Code (art. 346) prescribes the death penalty for the kidnapping of a minor if the victim dies, and for taking a hostage with a view to prepare or facilitate a crime (art. 337). The Penal Code prescribes jail terms from 10 to 20 years for minors under 18 in place of the death penalty (art. 52) and prohibits the execution of pregnant women until they have given birth (art. 16).
