The Court of Appeal in Kuala Lumpur upheld the death sentence imposed on a car towing operator by the High Court for trafficking in 86.47gm of heroin in 1990.
Court of Appeal judges Datuk Abdul Hamid Mohamad and Datuk K.C.Vohrah and High Court Judge Datuk Faiza Tamby Chik dismissed Tan Ewe Huat's appeal against his conviction and death sentence.
In a 17-page judgment delivered by Vohrah, it said the court saw no reason to interfere with the High Court's decision.
"The appellant (Tan) was properly convicted on the basis of his admissions in the cautioned statement which had been properly admitted by the trial judge and which had been properly considered in the light of his defence and all evidence of the case as we had observed," Vohrah said.
Tan was convicted and given the mandatory death sentence by the Shah Alam High Court on May 19, 1995 for drug trafficking in a house in Ampang on September 13, 1990.
