The death penalty is still provided for under the Constitution but is only applicable under the Army Forces of Malta Act 1970 for aiding the enemy, communication with the enemy and injurious disclosures, mutiny and insubordination, and failure to suppress mutiny. Malta has been abolitionist for ordinary crimes since 1971, and the last execution took place in 1943.
