The death sentence passed on Uchenna Uwachukwu for killing his business partner, Benjamin Iheama, by the high court and court of appeal was confirmed by the Supreme Court.Nwachukwu will be hanged for killing Iheama, who before his death was involved in a joint electronics business with Anthony Nwachukwu, the appellant's brother.
As presented by the court, the facts of the case stated that Anthony Nwachukwu, now at large, actually masterminded the murder of Iheama, his business partner. He was said to have recruited his two brothers, Uchenna and Christopher Ndulaka, deceased, to kill Iheama.
On January 20, 1985, the said Anthony Nwachukwu and late Christopher Ndulaka went to Iheama's room and told him they had come to kill him. They strangled him and put him in his 505 Peugeot car for burial in a shallow grave along the Uratta Express road in Owerri, Imo State.
Uchenna was convicted of murder by the high court while his appeal to the Court of Appeal in Port Harcourt was dismissed. He consequently appealed to the Supreme Court.
