The Finnish parliament said it would refuse to extradite a person to a third country if threatened by the death penalty or "other inhumane treatment". The logic, said several EU diplomats, was that this would include military tribunals.
"The Americans cannot seriously set their own rules for fighting terrorism and expect us to follow suit," said a Spanish official. "This is not what multilateralism is about."
The Europeans said the US could not expect them to extradite suspected terrorists to military tribunals.
EU states do not extradite individuals to the US unless they receive assurances the death penalty will not be applied. France and other countries have strongly criticised the courts.
