the Kitwe High Court, in Zambia, has sentenced a carpenter to death for repeatedly stepping on another man’s head during a fight who later died.
Judge Roydah Kaoma sentenced to death Morgan Kasonde 27, of Kapoto Township for murdering Geoffery Mwila on September 25, 2011.
The court heard that on the fateful day, Kasonde, who was in the company of his friend beat up Mwila until he became unconscious.
They court heard that the accused person who was wearing boots then started stepping on the deceased repeatedly on his head.
The victim was rushed to Kitwe Central Hospital (KCH) where he later died.
In defense, Kasonde told the court that he was provoked by what Mwila had said against him and his friend.
In delivering Judgement Ms Justice Kaoma said the prosecution had proved the case beyond reasonable doubt.
She said it was clear the accused caused the death of Mwila by unlawful assault and with malice afore thought.
Ms Justice Kaoma dismissed the accused person’s defense of provocation that he was provoked by the deceased through a remark he made against the accused and his friend.
“The prosecution has proved beyond doubt that the accused caused the death of the deceased by unlawful assault and with malice afore thought and I find the accused guilty of murder contrary to Section 200 of the penal code cap 87,” said the Judge.
Ms Justice Kaoma was of the view that if the remark was provocative, the accused and his friend could have reacted immediately but they did not.
